Former Attorney-General of the Federation and Minister of Justice, Abubakar Malami (SAN), has alleged that the Economic and Financial Crimes Commission (EFCC) violated the law by raiding his residential and business properties without proper authorisation.
In a statement issued by his Special Assistant on Media, Mohammed Bello Doka, Malami claimed that EFCC operatives, accompanied by heavily armed security personnel, forcefully entered and took control of properties linked to him. According to the statement, the officials marked the buildings and detained two individuals during the operation, allegedly without presenting any valid court order.
Doka noted that the incident occurred shortly after a visit by former Vice President Atiku Abubakar to Malami’s residence, raising concerns about the timing and possible motives behind the action.
He further pointed out that the legal case filed by the EFCC against Malami at the Federal High Court in Abuja is still ongoing, with no final ruling yet delivered. He stressed that the court had not granted any order permitting the invasion or marking of the properties.
The statement also argued that the interim forfeiture order previously obtained by the EFCC had already expired. According to Doka, the ex parte order issued on January 6, 2026, was valid for only 14 days and had since lapsed, making it insufficient to justify the agency’s actions.
Malami’s aide said EFCC officials were asked to produce a lawful court order during the operation but failed to do so, which he described as evidence of illegality.
He accused the anti-graft agency of using force to unlawfully occupy and assert control over the properties, describing the move as a breach of due process and established legal procedures.
Condemning the development, Malami’s office described the raid as a “flagrant disregard for the rule of law” and a “gross abuse of power,” warning that such actions could set a dangerous precedent in a democratic system.
The statement added that while Malami supports accountability and anti-corruption efforts, such actions must be carried out strictly within the confines of the law.
It also reaffirmed his willingness to cooperate with lawful judicial proceedings, stating that he would defend his rights and reputation through appropriate legal channels.
Malami’s office called on Nigerians and the international community to take note of the situation and its potential implications for justice, rule of law, and democratic governance in the country.
