Abuja, September 23, 2025 – The Federal High Court sitting in Abuja has granted leave to Hon. Amobi Godwin Ogah to apply for an order of Mandamus compelling the Independent National Electoral Commission (INEC) to investigate and prosecute the Minister of State for Labour and Employment, Nkeiruka Chidubem Onyejeocha, over alleged forgery of election results in parts of Abia State.
In the suit numbered FHC/ABJ/CS/1308/2025, filed by Amobi Ogah against INEC, the applicant sought an order directing the electoral body to probe and prosecute Onyejeocha for the alleged manipulation of polling unit results during the 2023 National Assembly election in the Isiukwuato/Umunneochi Federal Constituency of Abia State.
Delivering the ruling on Tuesday, 23rd September 2025, Justice M. G. Umar granted leave to the applicant to apply for the order of Mandamus, stating that the matter had established sufficient grounds for INEC to be compelled to act on the alleged electoral offence.
The court order specifically mentioned several polling units alleged to have been affected, including:
Isiukwuato LGA: Imenyi Ward 1, Units 002, 003, and 004. Umunneochi LGA: Mbala/Achara Ward 3, Unit 011; Ndiara/Umuelem/Ihie Ward 5, Unit 010; and Ezianaugwu Ward 6, Unit 001.
Justice Umar further adjourned the case to 11th November 2025 for hearing, directing that the respondent (INEC) be served accordingly.
The order, which was issued under the hand of Justice M. G. Umar and signed by the court registrar, Miss Daisy Esa, was certified as a true copy by the Federal High Court, Abuja.
This development marks a significant step in Amobi Ogah’s legal pursuit to challenge the alleged electoral irregularities that occurred during the House of Representatives election in Abia State — an election that had earlier been marred by controversy and contestation.
With the court’s approval, INEC is now legally bound to respond to the call for investigation and possible prosecution of the alleged offences as stipulated under Nigeria’s electoral laws
