The Gauteng High Court has dismissed, with costs, an application by the uMkhonto weSizwe Party (MKP) seeking to block the payment of pension benefits and post-term gratuities to former National Director of Public Prosecutions (NDPP), Advocate Shamila Batohi.
In its application, the MKP argued that the disbursement of public funds must be lawful, rational, and constitutionally justified, particularly in light of allegations of “misconduct” it levelled against Batohi. However, the respondents strongly opposed the bid, maintaining that the application lacked merit and should not succeed.
After considering the arguments, the court issued an electronic ruling on Caselines, dismissing Part A of the application, which sought an interim interdict. The court also ordered the MKP to pay legal costs on Scale C.
