Brady Kiser Cleared of Charges in Son’s Drowning Death, Says Maricopa County Attorney

The husband of social media influencer Emilie Kiser will not face criminal charges in the tragic drowning of the couple’s 3-year-old son, Trigg, the Maricopa County Attorney’s Office has confirmed.

Earlier this month, police in Chandler, Arizona, had recommended that Brady Kiser be charged with felony child abuse in connection with the incident, which occurred in May. However, following a thorough review, the county attorney’s office decided not to proceed with prosecution.

In a statement released on July 25, Maricopa County Attorney Rachel Mitchell said that after evaluating the evidence provided by the Chandler Police Department, the case did not meet the legal threshold required for charges.

“To secure a conviction, the state must prove beyond a reasonable doubt that the individual failed to perceive a substantial and unjustifiable risk, and that such a failure represented a gross deviation from the standard of care expected of a reasonable person,” Mitchell explained. “After careful review of the evidence submitted, it was determined this case does not meet that standard.”

The attorney emphasized that all cases brought before the office are held to the same standard: whether there is a “reasonable likelihood of conviction.”

The death of young Trigg has drawn widespread attention, particularly on social media where his mother, Emilie Kiser, has a significant following. The family’s loss has prompted an outpouring of sympathy and debate about accountability and parental responsibility.
